Correctional Program Specialist (Discipline Hearing Officer)

The DHO will conduct hearings at the institution, region, or other assigned institutions on all acts of misconduct by inmates referred to him/her by a Unit Discipline Committee or Regional Discipline Hearing Administrator in accordance with the procedures set forth in 28 C.F.R. Section 541.15. The hearings may be conducted in person or via video or telephone conferencing. The incumbent may certify Community Discipline Committee (CDC) actions on cases from Community Corrections contract facilities and Community Corrections Offices (CCO). Incumbent will conduct administrative fact finding hearings concerning alleged acts of misconduct and violations of prohibited acts (as defined in 28 C.F.R. Section 541.13), including acts which could result in criminal charges. The DHO will review incident reports and written statements; decide which witnesses need to be called; take and record testimony relevant to the charges; obtain, review, and weigh evidence; and determine whether or not the allegations of misconduct are supported by the evidence submitted. The DHO will impose disciplinary sanctions based upon, but not limited to, the nature of the offense, and impose sanctions in accordance with the provisions of 28 C.F.R. Section 541.17. This position involves the review and analysis of administrative rules, court decisions, and quasi-criminal procedures with assistance from legal counsel of the BOP. Incumbent will be involved in the training or mentoring of other DHOs, Alternate DHOs, or other staff as appropriate. Incumbent will be required to demonstrate and use excellent oral and written communication skills. Examines incident reports for accuracy and policy compliance, taking into consideration constitutionally mandated rights. Provides reports of DHO activities, findings, and significant trends as requested by the RDHA. Performs DHO functions at other BOP facilities due to vacancies, sick leave, annual leave, promotion, or for other causes. Prepares responses to BP-10s (Regional Administrative Remedy Appeal) pertaining to inmate discipline. May provide training and technical assistance to Community Corrections Centers (CCC), CCOs, and other contract facilities. Participates in required training for Community Corrections contractors in conjunction with the Regional CCO. Reviews and certifies Community Discipline Committee (CDC) reports for compliance with policies and Wolff v. McDonnell. Orders corrective action when necessary on CDC reports. Imposes final sanctions on all certified CDC reports and performs SENTRY transactions. Along with all other correctional institution employees, incumbent is charged with responsibility for maintaining security of the institution. The staff correctional responsibilities precede all others required by this position and are performed on a regular and recurring basis. Education There is no substitution of education for specialized experience for this position. Experience You must have at least one year of specialized experience equivalent in difficulty and complexity to the next lower grade level in the normal line of progression for the occupation in the organization. Specialized experience is directly related experience that included substantial involvement with a correctional program and provided a thorough knowledge of correctional techniques, or experience in meeting and dealing with people that demonstrated the ability to work effectively with inmates and associates in a correctional environment. Experience must have also demonstrated the ability to perform supervisory or administrative duties successfully. This includes (1) understanding the problems of custody, treatment, training, and release of inmates of penal or correctional institutions; (2) a thorough and comprehensive knowledge of an institution's internal policies, programs, regulations, and procedures; and (3) training subordinates, coordinating and directing activities and functions, evaluating performance of operations and the effectiveness of programs, and maintaining high standards or work objectives. This experience must have been gained in an administrative position, or in other positions that included the successful direction, or assistance in the direction of, an entire correctional program or a major phase of such a program. Credit will be given for experience gained in community, cultural, social service, and professional association on the same basis as paid work experience. To receive proper credit, you must show the actual time (such as number of hours worked per week) spent in the activities. The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
